Terms of Service

1. Agreement and operator

These Terms govern the Zenith app, zenithfit.app, connected wearable features, and support services. Zenith Fitness is published and operated by Alexander Serban. “Zenith Fitness,” “Zenith,” “we,” “our,” and “us” refer to Alexander Serban operating the Zenith service.

By creating an account or using Zenith, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Zenith.

2. Eligibility and accounts

You must be at least 13 to use a Zenith account. If local law requires parent or guardian consent, you may use Zenith only with that consent. Provide accurate information, secure your account and devices, and notify support if you suspect unauthorized access.

3. Service status and availability

Zenith provides fitness, workout, running, nutrition, hydration, weight, recovery, progress, social, and wearable logging. Availability depends on device, region, permissions, account state, network, connected services, and release channel.

Features and connected services may change over time. Keep independent copies of information when a permanent personal record matters.

4. Acceptable use

Do not break the law; violate another person’s rights; harass, impersonate, exploit, or deceive; upload unlawful or malicious content; bypass security or access controls; scrape or resell protected content; misuse another account; or use Zenith for regulated professional or emergency services.

Zenith may limit or remove activity that reasonably appears to violate these Terms, protect users, or preserve service integrity.

5. Health and emergency safety

Zenith is a fitness and logging tool, not a medical device, healthcare provider, diagnosis, treatment, emergency service, or substitute for qualified professional advice. Use judgment, follow local rules, stay aware of your surroundings, and stop activity when symptoms or conditions make it unsafe.

Calories, nutrients, heart rate, recovery, readiness, GPS, elevation, sleep, pace, and similar values may be estimated, incomplete, delayed, or wrong. Check source devices and labels when exact information matters.

6. Food-data provider terms

Some food-search and nutrition content may be provided by the fatsecret Platform API. By using a Zenith feature that obtains or displays that content, you also agree to be bound by the fatsecret Platform API Terms of Use, which are incorporated into these Terms for those features.

Provider-supplied nutrition information is for logging and informational use. It is not medical, diet, nutrition, or health advice, guidance, or diagnosis. Product formulations change; check current packaging when exact values matter.

Food search and logging are available to users. When you select a FatSecret result, the durable Zenith log retains only permitted provider identifiers and Zenith's permitted parity nutrition and log fields. Restricted provider-detail payloads are not durably stored and are removed or refreshed within the applicable 24-hour boundary. Saved-meal, export, restore, and insight features do not retain or reproduce restricted provider detail.

Provider content is identified where displayed. Third-party coverage, labels, serving data, and availability may change. Zenith may remove, refresh, or re-fetch provider content to honor provider rules and data-quality requirements.

7. Permissions and third parties

Optional features can connect to Apple Health, Apple Watch, exact Garmin targets offered by your installed build, device location, notifications, camera or photo access, Apple authentication, cloud hosting, email delivery, and food-data providers. Garmin targets labeled as a controlled acceptance beta are not hardware-verified support claims. You control device permissions. Third-party services have their own terms and availability.

If your installed Zenith build offers Garmin and you grant the current notice and connect it, data submitted through the Zenith Garmin application is submitted to Zenith, not Garmin. Garmin has no responsibility or liability for that data or for Zenith's handling of it. Zenith is not affiliated with, sponsored, certified, or endorsed by Garmin.

8. Current access and future purchases

Core tools are unlocked. No Premium product, price, trial, subscription, purchase, checkout, or restore flow is active. Report any unexpected paywall.

If a later App Store release enables a purchase, Apple’s purchase sheet will show the current product, price, billing period, trial (if any), renewal, and cancellation terms before confirmation. Apple processes the transaction and manages refunds under its policies.

For an Apple-distributed build, Apple’s Licensed Application End User License Agreement also applies to the extent required by Apple.

9. Your content and privacy

You retain your rights in records and content you create. You give Zenith limited permission to process, host, transmit, display, back up, moderate, and otherwise use that content only as needed to operate, secure, support, and improve chosen features, comply with law, and enforce these Terms.

The Privacy Policy describes personal information, Health-derived information, cloud continuity, provider-restricted food data, diagnostics, export, retention, and deletion.

10. Intellectual property

Zenith’s software, design, branding, and original content are protected by applicable law. Subject to these Terms, Zenith grants you a personal, limited, revocable, non-exclusive, non-transferable license to use the app for its intended noncommercial purposes. Third-party content remains subject to its owner’s rights and terms.

11. Changes and termination

Zenith may add, change, suspend, or retire features. Continuous or error-free availability is not guaranteed. You may stop using Zenith at any time. Zenith may suspend or terminate access when reasonably necessary for a material Terms violation, security risk, legal requirement, user harm, or service shutdown.

12. Disclaimers and liability

To the fullest extent permitted by law, Zenith is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

To the fullest extent permitted by law, Zenith and its operator are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages or for lost profits, opportunities, goodwill, or data. Aggregate liability will not exceed the greater of the amount you paid to Zenith in the prior 12 months or the minimum required by law. Mandatory consumer rights and liability that cannot lawfully be limited remain unaffected.

13. Disputes and updates

Applicable law governs these Terms without depriving you of mandatory protections where you live. Contact legal@zenithfit.app before a formal claim so the parties can try to resolve it informally; you may still use any regulator, court, or process available under law.

Zenith may update these Terms as the service, providers, or law changes. The current version and update date remain on this page, with additional notice when required.
